This is a translation. Only the German version is legally binding. To the German version

This version is a draft. I will fill in the places marked “Details to follow” as soon as the details are settled.

1Contracting party and scope

Your contracting party is:

Træhøj, owner Birgitte Arnason
Øster Kjulvej 2
9850 Hirtshals
Denmark
CVR 34814643
Phone +45 23 34 98 75, email Staldnordkap@live.de

These terms apply to contracts with consumers. They do not limit your statutory rights.

2Ordering and conclusion of the contract

This is how you order:

  • You choose a piece or design it in the configurator and put it in the cart.
  • In the cart you see all pieces with your selection and the prices. There you can change quantities and remove pieces; in the configurator you can change your selection until you order.
  • By clicking “Order with obligation to pay” you place a binding order.
  • You then go to Stripe’s payment page and choose the payment method there.
  • Once the payment has been approved, I confirm your order by email straight away. The contract is concluded with this order confirmation.

If you cancel on the payment page, no contract is concluded. Your cart is kept.

If you enquire about a piece, I send you a quote with a fixed price. You accept it by clicking “Order with obligation to pay” via the link in the quote. After that, the same applies as for an order in the shop.

The language of the contract is German. I store the contract text. With the order confirmation you receive these terms of sale, the withdrawal information and the withdrawal form as PDFs. You can open, save and print this page at any time.

3Prices and shipping costs

All prices are final prices in Danish kroner (DKK). On moms (VAT): Details to follow: moms status and price note.

Shipping costs: Details to follow: shipping costs per country. You see the total amount with all costs before you click “Order with obligation to pay”.

I deliver to Details to follow: delivery area. You can pay with Details to follow: payment methods. I charge no fees for the payment itself.

If your bank converts from another currency, it may charge fees for this. I have no influence on that.

4Payment

Finished pieces: When you order, Stripe reserves the amount on your payment method. It is only charged when I ship your order.

Pieces made to your specifications: Here you pay in advance, because I make the piece only for you. You expressly agree to this before ordering by ticking a separate box. Without this consent you cannot order a made-to-order piece.

Payment is handled by Stripe. Your card and account details are held only by Stripe, not by me.

5Delivery

Delivery time for finished pieces: Details to follow: delivery time. Unless otherwise agreed, I deliver no later than 30 days after the contract is concluded. For pieces made from your hair, the delivery time counts from receipt of the hair (section 8).

Until the parcel reaches you, I bear the risk of it being lost or damaged.

6Right of withdrawal

For finished pieces and pieces without personal specifications you have a right of withdrawal of 14 days. How it works is explained in the withdrawal information. The quickest way to withdraw is the Withdraw from contract function.

There is no right of withdrawal for pieces that I make to your specifications or that are clearly personalised for you, for example jewellery from your own horse’s hair. Whether your piece is one of them is shown in the summary before you order.

7Defects and complaints

If a piece is defective, you have the statutory rights. You can claim a defect up to 2 years after delivery. If it appears in the first year after delivery, it is presumed to have existed at delivery.

You can ask me to repair the piece or send you a new one. If that fails, you can reduce the price or withdraw from the contract. Before a repair I tell you that you can choose between a repair and a new piece, and that the 2-year period is extended once by 12 months after a repair.

It is best to report a defect as soon as you notice it, by email or phone. I set no deadline for reporting it.

Horsehair is a natural material. Characteristics that I told you about before you ordered and that you expressly accepted by ticking a separate box are not a defect.

8Made-to-order pieces and sending hair

How it works

After your order you receive a code by email. Write it on a note and put it in an envelope with the hair, together with your name, your address and your email address or phone number. As soon as the hair reaches me, I get in touch and we discuss the design. Before shipping you receive a photo of the finished piece.

Which hair, how much

Ideally a finger-thick strand from the tail, as long as possible, cut right at the root of the tail and unwashed. For pendants and earrings a small strand is enough, for beads very little.

Sending the hair

Send the hair to: Nordkap, c/o Birgitte Arnason, Øster Kjulvej 2, 9850 Hirtshals, Denmark. Please send it with tracking. Until the hair reaches me, the shipping risk lies with you.

Deadline and reminder

Please send the hair within Details to follow: deadline for sending in days of your order. If it does not arrive, I will remind you. If it still does not arrive after that, I can end the order and refund what you have already paid.

Not enough hair

If the hair is not enough for the piece ordered, I will suggest a different version. If you decline, I refund what you have already paid.

Leftover hair

If you wish, I send leftover hair back to you with the jewellery. Otherwise I dispose of it Details to follow: period for leftover hair after shipping.

Delivery time

The delivery time begins when your hair reaches me and is Details to follow: delivery time from receipt of the hair.

Payment and cancellation

For made-to-order pieces you pay in advance (section 4). If you no longer want the piece before I have started work, I refund the full amount. After that, I keep the part that corresponds to my documented work and refund the rest.

Withdrawal and natural material

There is no statutory right of withdrawal for pieces made from your hair (section 6). Your rights in the event of defects remain (section 7). Horsehair differs from horse to horse in colour, shine, length and thickness; I tell you what to expect before you order.

9Gift vouchers

These rules apply when you buy a gift voucher from me.

  • Types: Details to follow: vouchers offered (value or service).
  • Validity: Details to follow: validity. It is also printed on the voucher.
  • You redeem a value voucher with an order in the shop. If the voucher is worth more than the order, the remainder stays valid for your next order.
  • If you wish, I pay out a voucher with a code at its printed value while it is valid and for up to 1 year after it expires. I charge no fee for this.
  • Whoever has the code can redeem it. If you lose the code, please get in touch: if it has not been redeemed yet, I block it and send you a new one.
  • You can withdraw from the purchase of a voucher within 14 days (withdrawal information).

10Liability

I am liable in accordance with the statutory provisions. These terms do not limit my liability.

11Complaints

If you are not satisfied, please write to me first. If we cannot find a solution, you can contact the Danish complaints body for consumers:

Nævnenes Hus, Forbrugerklagenævnet
Toldboden 2
8800 Viborg
Denmark
naevneneshus.dk (opens in a new window)

If I reject a complaint in whole or in part, I will name this body to you again in writing.

12Applicable law

Danish law applies. You keep the protection of the mandatory provisions of the country where you have your habitual residence.

If you live in the EU, you can also sue me where you live, and I can only sue you there. There is no agreement on the place of jurisdiction in these terms.
